Q: I am in a same-sex marriage, and we have been legally married in California for 6 years now. Are we eligible for community property tax benefits at the federal level?

by Rose Law Firm of Napa Valley, Inc. | Nov 9, 2022 | Q&A |

A: Yes, you are! However, it is also important to note that, according to the IRS, individuals who have entered into a registered domestic partnership under state law are NOT considered married for federal tax purposes.
