Q: Should you include a guardianship nomination in your estate plan if you have children?

by | Mar 1, 2023 | Estate Planning, Q&A |

A: In the event of an unexpected death, courts will consider the best interests of a child when determining who is the best fit as guardian, and the wishes of a parent are generally given tremendous weight in making that decision. If it matters to the parent who would raise their child in their absence (or who they DON’T want to raise their child), then including a guardianship nomination is an absolute must.
